MTA staff may assist you with the booking of hotels, apartments, transfers, sightseeing, spas and the like, but you will be solely responsible for settling all and any costs arising directly with the service provider/operator. Under no circumstances whatsoever will MTA be liable for any losses howsoever arising from the performance or non-performance of any service provider/operator. MTA will act as the Payment Representative of MTA Ukraine in collecting charges in the UK. MTA is authorised by MTA Ukraine to bring any action that may arise in respect of the non payment of these charges. It is acknowledged by you that Medical Tour Abroad does not provide dental services and it is expressly agreed that no liability whatsoever will attach to it arising out of the performance or non-performance of these Trading Terms or the Treatment Plan or any modifications to it. Consultations Initial assessments are free. During your consultation a panoramic x-ray (OPG) may be required to assess the state of your teeth and mouth. If you have a recent x-ray, we can use that. Alternatively we can take an x-ray free of charge abroad. If your consultation is in UK, this will constitute an Initial Assessment only. During your Initial Assessment you will receive a personalised Treatment Plan which is valid for 60 days. Your final diagnosis will be set up abroad, often with the involvement of further specialists (for example: an implantologist assessing the amount and strength of your bone tissue to determine the feasibility of placing implants; a periodontologist assessing the health of your gums to determine the likelihood of inflammation, gum recession and the like; an orthodontist assessing the feasibility of moving your teeth with orthodontic methods; a gnathologist measuring your bite to determine where you apply the highest amount of pressure to your teeth, etc). Treatment Options Please make sure you understand the implications of your treatment and the alternatives before agreeing to any treatment. Special offers Dental treatment special offer package prices are valid only in conjunction with a package in its entirety and do not apply to any single component thereof. Medical Tour Abroad is not able to provide you with a breakdown of the cost for each individual component of your purchase. No refund will be given for unused or partially used package components. All promotions are subject to availability and cannot be combined with any other Medical Tour Abroad offers or rebates. Adjustments made to package pricing will not be made after payment has been applied. After payment has been made, no subsequent rate reductions will be applied retroactively. Course of Treatment It is our goal that you receive adequate information on the treatment options available to you, together with their consequences, costs and possible risks. You should be able to discuss with your dentist the options available in order to select a course of treatment that is medically sound, aesthetically pleasing and financially affordable to you. In some cases it may only become apparent after the commencement of your treatment abroad that the course of treatment discussed during your Initial Assessment has to be modified. Sometimes this happens as old crowns are being removed and loose teeth pulled. At other times it may happen at the very onset when specialists are consulted. The implications of such findings will be explained, and a modified treatment plan will be agreed. In some cases, the modified treatment plan may involve an extra trip abroad. During this process you may at any time decide not to continue with the treatment. In this instance you will only have to pay for treatment and laboratory work which has been provided. MTA has the absolute right to discontinue treatment at any time without any obligation for compensation if you are not medically or mentally fit for the recommended treatment or if your payment obligations are not met. In some cases MTA may need to make changes to your appointment time and/or the place of treatment and/or the treating specialist. In this event we will contact you to advise you of those changes at the first available opportunity. MTA may at any time without notifying you make any changes to the services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the services. Travel Travel, accommodation, meals and other ancillary expenses of treatment abroad will in all cases be borne by you, regardless of whether those expenses are incurred in respect of a consultation, treatment, checkups, guarantee or any other reason. Always allow plenty of time for flights as we may not be able to reschedule your appointments. If you do not allow sufficient time for your stay abroad and laboratory work is delayed, you may need to make an additional trip. In such cases, when laboratory work is delayed, MTA will cover the flight and accommodation costs of the additional trip with a similar class of flight and level of accommodation you paid for yourself, up to a maximum of 20% of the dental charges made to you during that visit and the extra trip. Cancellation of Dental Treatment Cancellations for scheduled dental treatment are only accepted in writing (e-mails and faxes sent directly to Medical Tour Abroad) and must be received no later than 72 hours (3 working days) in advance. In the case of cancellation for a patient’s first visit, there is no cancellation fee. However, due to the restrictive nature of the timing of treatments, a cancellation penalty of GBP 50 will be charged for the cancellation of a subsequent visit. Customers are responsible for any cancellation fees imposed by other travel suppliers, such as airline or hotel cancellation fees or charges. Please note that for some hotels or apartments, once your reservation is confirmed, your reservation may be wholly non-refundable. Guarantees Different types of work are covered by different guarantee conditions. The aesthetic and functional performance of the work done in your mouth will depend on the workmanship of the laboratory work involved as well as on the condition of your teeth, gums and bones. Factors affecting the length of the guarantee period include general oral hygiene, smoking, diabetes, bone density and diet. Your guarantee will typically be conditional on regular checkups. (1) If you travel to MTA for aftercare, and it is determined that your work falls under guarantee, replacement or restoration of the original work will be performed free of charge. (2) If you see an independent dentist for any problem associated with the work performed by a MTA dentist, we will require a detailed report from that dentist in order to properly assess your condition. If MTA receives an adequate report and determines that the independent dentist performed work that was required, the charges made by that dentist will be covered up to £50. If however the independent dentist interferes in any way with the work originally carried out by the MTA dentist, you may lose the benefit of any guarantee. (3) Clinics are not liable for any unforeseen root canal treatment after having a tooth/teeth prepared for crown & bridgework. Complaints Should you have any complaints with the dental work performed, we suggest that you immediately approach your dentist. If you have complaints with any other aspect of your customer experience, or if your dentist is not available, please contact MTA customer care at This e-mail address is being protected from spam bots, you need JavaScript enabled to view it Failure to bring your complaint to the attention of your dentist or MTA at the earliest opportunity will be considered proof that the services were satisfactorily provided. If your dental problem can not be satisfactorily resolved over the telephone or email, you may need to see a dentist. (1) Our preference is for you to travel to the clinic which treated you originally. We will try to organise for the dentist who carried out your treatment to see you again, but this may not always be feasible, consequently another dentist associated with MTA may need to see you. (2) As a alternative, you may see a local dentist with your problem. If it is determined that your work falls under guarantee, it will be treated according to the conditions described in the Guarantee section. Should your complaint not be satisfactory resolved by MTA then you may wish to make use of the Dental Complaints Service of the General Dental Council of Ukraine. Disclosure In order to perform our services you will be required to disclose certain personal information, including your personal data, travel plans and health records (“the Information”) to MTA or any agent appointed by it to receive such information. No liability will arise in respect of any losses suffered by you where the information disclosed is found to have been incorrect or incomplete. It is your sole responsibility to ensure that the information provided is accurate and to immediately notify MTA, or any agent appointed by it to receive such information, of any changes to it. Data Protection MTA will always respect your privacy and any personal communication between yourself and itself or any associated company. The information that MTA collects from you is only that required by MTA or any associated company to provide you with the information, products or services requested. MTA not trade, rent or sell client details to third parties. Should MTA's intentions change it will be done only with your authorisation. MTA will always comply with any data protection legislation currently in force. Other than as set out above, MTA will not disclose any of your personal details without your permission unless MTA is required by law to do so (for example, if required to do so by a court order or for the purposes of prevention of fraud or other crime). Liability In addition to any liability expressly or by implication excluded under these Trading Terms, MTA shall not be liable for consequential losses and its liability shall not in any case exceed a total amount equivalent to the amount payable by the patient for the treatment he/she received. Other These Trading Terms and the associated Treatment Plan constitute the entire agreement between the parties and supersede any previous agreement or understanding. You expressly confirm that you have not entered into this contract on the basis of any representation that is not expressly incorporated into this contract. No failure or delay by either party in exercising any of its rights under the contract shall be deemed to be a waiver of that right and no waiver by either party of any breach of contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision. If any provision of these Trading Terms is held to be unenforceable in whole or in part, the validity of the other provisions of these Trading Terms and the remainder of the provision in question shall not be affected. MTA reserves the right to update or change these Trading Terms from time to time to reflect changes in its operating practice, changes in law affecting the provision of its services or for other good reasons. Ukrainian law shall apply to this contract and the parties agree to submit to the exclusive jurisdiction of the Ukrainian courts. In the event of a dispute arising under or in connection with this contract, the parties shall first attempt to resolve such dispute amicably through conciliation. If the parties are not able to resolve the dispute amicably within thirty days (30), starting from the date on which one party provided the other party with full written particulars of the nature of the dispute, then either party may seek the determination of the Ukrainian courts. Any modifications to the Treatment Plan or Trading Terms must be made in writing and signed by the parties. |
